This is the sixth session of a conference entitled “Presidential Power in America: the Constitution, the Defense of a Nation, and the ... all » National Ethos.” This session, chaired by Professor Christopher Pyle of Mount Holyoke College, explores the use of Article II of the constitution. The current administration has repeatedly invoked Article II in defense of its authorization of domestic spying, torture and other acts done in the name of national security. This panel will explore Article II and its application by the current administration. What specific powers does the president have in wartime for directing a war, spying and gathering intelligence? Has the current administration overlooked Youngstown, arguably the court’s most important case on executive power? Panelists include: David Adler, Peter Irons and Jules Lobel.
